To receive accident benefits, you must notify your insurance company within seven days of the accident. Once you receive the accident benefits application, you’ll have 30 days to submit the completed form to avoid delay – or possibly denial – of accident benefits.


Under Ontario law, you have two years after the date of your accident to file a lawsuit against an insurance company or the party you believe to be at fault. If you intend to sue a municipality, you must submit your notice to sue within 10 days.


If the injured party is a child, you have until two years after their 18th birthday to file a claim. This allows time to observe the child’s development post-injury. Over this time, you’ll need to keep sufficient documentation to establish your case when the time comes.
